SmartBet Affiliate Terms

§ 1. About these terms
These terms govern the SmartBet Affiliate Program between you (the Affiliate) and SMARTBETGG sp. z o.o., ul. Jana i Jędrzeja Śniadeckich 20D/7, 35-006 Rzeszów, Poland, KRS 0001248436, NIP 5170472427, REGON 545025050 (SmartBet, we), operator of smartbet.gg. By applying to or taking part in the program, you accept these terms.
§ 2. Definitions

| Commission Period | The 12 months starting on the date of the Referred Customer's first payment. |
§ 3. Joining the program
- You apply through the form on smartbet.gg. Joining is free.
- We review every application by hand, usually within 48 hours, and email you our decision.
- If approved, you receive your Referral Code, Link and access to the Partner Dashboard.
To take part you must be at least 18 years old and allowed to promote football statistics services where you live and where your audience is. We may decline any application without giving a reason. You may hold only one affiliate account.
§ 4. Commission
- You earn 30% of the Net Amount of every payment a Referred Customer makes during the Commission Period. This applies to monthly and yearly plans alike; a yearly plan bought within the Commission Period earns commission once, on its full payment. After 12 months, commission on that customer ends.
- Attribution: a sale counts as yours if the customer uses your Referral Code at checkout, or buys within 60 days of clicking your Link. If several affiliates qualify, the last code or click wins.
- No commission on: existing or former SmartBet customers, your own purchases or those of people in your household, payments made after the Commission Period, and taxes or fees.
- Records: our affiliate platform is the record of clicks, referrals and commission. Tell us within 30 days if you believe something is missing.
§ 5. Discount for your audience
Your Referral Code gives new customers 30% off their first payment on any Premium plan. It cannot be combined with other codes or seasonal promotions; during a SmartBet promotion we may let your referrals use the promotional price instead, and you still earn commission on it. You may not change the discount or promise any other offer on our behalf.

You are responsible for any taxes on your commission. Affiliates acting as a business invoice SmartBet for each payout; we may ask individuals for the details we need to meet our tax obligations before paying. We are not responsible for payouts lost because of a wrong PayPal email you provided.
§ 7. Refunds, chargebacks and fraud
If a payment is refunded or charged back, the commission on it is cancelled. If that commission was already paid, we deduct it from your next payouts. Commission from fraudulent, fake or self-generated referrals is void, and we may recover any amount already paid for them.
§ 8. Promotion rules
Promote SmartBet the way we built it: honest, stats-based and transparent about misses. Breaking these rules may lead to suspension and loss of unpaid commission (section 11).
You must:
- Describe SmartBet accurately, as a data-driven or stats-based football statistics service.
- Clearly disclose that you earn a commission, as required by the platform you post on and the law where your audience is.
- Address adults only and follow the advertising rules for gambling-related content of every platform you use.
- Include a responsible-gambling note (18+) where your content mentions betting.
You must not:
- Promise wins, profits, guaranteed results or specific win rates, or use terms such as "sure bets" or "fixed matches".
- Describe SmartBet as "AI" or "AI-powered", or present its statistics as betting advice.
- Target people under 18, or audiences in countries where promoting such services is not allowed.
- Bid on "SmartBet" or similar terms in search or social ads, or run ads that impersonate SmartBet.
- Post your code on coupon or deal sites, use spam, fake reviews, cookie stuffing, incentivised clicks or misleading redirects.
- Combine your code with other promotions or offer cashback from your commission without our written approval.
§ 9. Use of the SmartBet brand
We give you a limited, revocable right to use the SmartBet name, logo, screenshots and materials we provide, only to promote the Program. Do not alter the logo, register domains or social handles containing "SmartBet", or suggest you are SmartBet or its employee. Stop using our brand when your participation ends.
§ 10. Tracking, data and privacy
Referrals are tracked by cookies and Referral Codes through our affiliate platform provider, PromoteKit. We process your application and account data (name, email, channels, PayPal email) to run the Program and pay you, as described in our Privacy Policy. Your Partner Dashboard shows aggregated referral data; you do not receive Referred Customers' personal data and must not try to identify them.
§ 11. Suspension and termination
- You may leave the Program at any time from your Partner Dashboard or by email.
- We may end your participation with 14 days' notice for any reason, or immediately if you break these terms.
- On a normal exit, we pay the commission you have earned up to the end date once it passes the hold period, even below €50. No commission accrues after that date.
- If you break these terms, we may suspend your account during review and withhold or cancel unpaid commission linked to the breach.
§ 12. General
- Changes: we may change these terms or commission rates with 30 days' notice by email. Changes do not reduce commission already earned. Staying in the Program after that date means you accept the change.
- Independent relationship: you act on your own behalf, not as our employee, agent or partner in law. The Program is non-exclusive.
- Liability: the Program is provided as is. Except where the law does not allow it, our total liability to you is limited to the commission paid to you in the previous 12 months. You are responsible for your own content and its compliance with the law.
- Governing law: Polish law applies. Disputes go to the courts competent for SmartBet's registered office, unless consumer law where you live says otherwise.
